Indictment returned on incest charges for Perry man

HAZARD — A Perry County man has been indicted this month on charges that he had sexual intercourse with his juvenile, blood-related niece.

Johnny L. Melton, 42, of Hazard, was indicted on three counts of incest, two counts of first-degree rape, and one count first-degree unlawful imprisonment.

Between April 17 and April 19 this year, Melton is alleged to have knowingly and unlawfully restrained the juvenile under circumstances which exposed her to a risk of physical injury. It was also during this time that Melton was accused of having sexual intercourse with the juvenile on more than one occasion.

Melton was arrested by the Kentucky State Police in April in Winchester for custodial interference, according to court records, and the juvenile was in his presence at the time of the arrest.

After being separated from her uncle, the juvenile told police Melton had taken her to the Daniel Boone Motor Inn in Hazard and had sexual intercourse with her on more than one occasion.

Trooper Billy Pollard wrote in the arrest citation that he had interviewed Melton on May 5 at the KSP Post 13 about the allegations.

“During the interview, Johnny Melton stated he did have sexual intercourse with the juvenile on more than one occasion,” Pollard wrote.

Melton faces a possible sentence of 10-20 years if convicted. He is being held at the Kentucky River Regional Jail with a $100,000 cash bond. His arraignment is set for June 20.
