Man pleads guilty in assault case

HAZARD—A Knott County man has pleaded guilty to an amended assault charge, and could spend the next eight years in prison.


Circuit Judge William Engle accepted a guilty plea from 43-year-old Brian Gayheart on Sept. 26 on an amended charge of second-degree assault. Gayheart was originally charged with first-degree assault, a Class B felony punishable by a maximum of 20 years in prison.


Gayheart was indicted in Perry County in March on an allegation that he was operating a motor vehicle under the influence when he collided with another vehicle, causing serious injury to other operator. The crash occurred on June 30, 2012.


According to Commonwealth’s Attorney John Hansen, Gayheart entered the plea in exchange for a sentence of eight years to serve, adding the victim in the case also agreed with the plea.


Gayheart is set for sentencing on Oct. 31.
