Hazard man charged with rape, sodomy

Thomas Fugate, 41, of Hazard was taken into custody on September 18th and charged with rape 1st, sodomy 1st, unlawful imprisonment 1st, and terroristic threatening. The charges involved a 16 year old female.

According to Sgt. Isaac Whitaker of the Hazard Police, the juvenile went to the police and told them that Fugate had alleged inappropriate sexual relations with her. Whitaker said he and other officers responded to Fugate's residence and requested he come to the Police Department for an interview.

When told about the allegations made against him, Fugate reportedly said, "I will kill her."

Based upon the threat he was taken into custody and taken to the Hazard Police Department for questioning. At the Police Department Sgt. Whitaker said Fugate evoked his fifth amendment rights, and refused to talk.

Whitaker said after receiving corroborating evidence in the case, Fugate was lodged in the Kentucky River Regional Jail and the sex charges were filed against him.

More charges are pending as a result of the investigation by Sgt. Whitaker and Patrolman James East of the Hazard City Police Department. Fugate is lodged under a $100,000 cash bond.
